  • Delivery evidence must be interpreted by the event and system that recorded it.
  • Delivery or display does not establish reading, understanding or assent.
  • Preserve receipt records with the relevant document and subsequent signing actions.

What is electronic delivery evidence?

Electronic delivery evidence is information about a document or message being sent, delivered or accessed. It may include timestamps, destination details and system notifications. Its value depends on which event was recorded, not simply the word “delivered.”

Sending, delivery, display and acknowledgment

  • Sent: a sender or service dispatched the invitation.
  • Delivered: the relevant transport or service reported a delivery outcome.
  • Opened or displayed: an access or display event was recorded.
  • Acknowledged: a recipient performed the stated acknowledgment action; its wording determines what was acknowledged.

For email, RFC 3464’s delivery-status specification expressly separates successful delivery from reading. RFC 8098’s message-disposition specification likewise states that a displayed notification does not guarantee the content was read or understood. These are technical email distinctions, not a claim that every signing platform uses identical labels.

Does receipt establish agreement?

Receipt and assent answer different questions. A person may receive a document without accepting its terms. An acknowledgment of receipt is not automatically a signature, approval or confirmation of the sender’s interpretation.

Relate the event to the particular document version and intended recipient. Preserve the surrounding signing evidence and, where applicable, the completion report. Neither a delivery notification nor a report title makes disputed identity or intent conclusive.

What should be retained?

Keep relevant delivery events with the document and later actions under the appropriate record-retention policy. If a transaction requires formal service or a special registered-delivery process, establish that requirement separately; an ordinary signing notification should not be assumed to meet it.

A Common Case: Checking an insurance application’s progress

Suppose a Florida insurance agency sees a delivery event for an application invitation. Staff would still check the applicant’s outstanding signing actions before treating the application as approved. The notification would be retained for its actual meaning, without inventing acceptance from delivery alone.
