A sublease agreement contract template is a legally binding document that allows a tenant (called the sublessor) to rent out part or all of their leased space to someone else (called the sublessee). It must include landlord approval, key terms, and a reference to the original lease. Download a free, customizable template, and sign everything securely using Sign.Plus.
A sublease agreement is a written contract where a tenant rents out their leased space to another person or business for a set period of time. The original tenant remains responsible to the landlord, but the new person (the sublessee) agrees to follow the rules of the lease.
Lease: A deal between a landlord and a tenant.
Sublease: A deal between a tenant and someone else, while the tenant still follows the main lease.
Assignment: When a tenant completely hands over their lease to another person (they usually don’t come back).
Going abroad for a semester? Sublease your apartment while you’re away.
Have unused office space? Sublease part of it to another business.
Need to leave your rental early? Sublease it while you finish your lease term.

List the full names and contact details of the sublessor (you) and the sublessee. This is like writing down who’s who in the agreement.
Describe the space being subleased. Is it a bedroom, the whole apartment, or just part of an office? It should be clear where the sublessee will live or work.
Clearly state the start and end dates of the sublease. Make sure the dates fit within the timeline of your original lease, If your lease ends in December, don’t sublease until January.
Spell out how much the sublessee will pay, when payments are due, and if a security deposit is required. This works like setting rules for a shared phone bill—everyone knows their part and when to pay.
Say who pays for water, electricity, internet, and other services. Mention if the place is furnished or not.
Include written permission from your landlord and attach a copy of the original lease, or refer to it directly.
Explain what happens if someone breaks the rules. Can the sublease be ended early? What penalties apply? Think of this like a safety net, it protects everyone if things go wrong.
Include any rules the sublessee must follow (no smoking, quiet hours, pet policies). Also add any required legal disclosures.
State whether the sublessee can sublease the space again (usually not allowed), and how to send legal notices.
Mention which state’s laws apply. This is helpful if there’s ever a legal dispute.
